365 BPM Events: General Terms & Conditions and Indemnity

PLEASE READ THIS DOCUMENT CAREFULLY AND IN ITS ENTIRETY.
BY PROCEEDING WITH REGISTRATION FOR OR PARTICIPATION IN ANY EVENT ORGANIZED BY 365 BPM, AND BY TICKING THE “I AGREE” CHECKBOX DURING ONLINE REGISTRATION OR CHECKOUT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO ALL THE TERMS AND CONDITIONS BELOW. THIS CONSTITUTES A BINDING AGREEMENT.

1. Event Description:
This Agreement pertains to my voluntary participation in any event (hereafter referred to as “the Event”) organized by 365 BPM (hereafter referred to as “the Organizers”). Events may include, but are not limited to, physical activities (e.g., runs, yoga sessions, fitness challenges, ice baths, breathwork sessions), music performances (e.g., parties, festivals, concerts), interactive workshops, social gatherings, and any other related activities as advertised or conducted by 365 BPM.

2. Voluntary Participation and Assumption of Risk:
I, the undersigned participant, confirm that my participation in any 365 BPM Event and any associated activities is entirely voluntary. I understand and acknowledge that participation in any such activities carries inherent and significant risks of property damage, serious bodily injury, illness, disability, and/or death. These risks include, but are not limited to: physical exertion, environmental conditions (e.g., terrain, weather), contact with other participants, exposure to loud music/lights, consumption of food/beverages, equipment failure, and potential medical incidents. I am aware of and voluntarily assume all such risks, whether known or unknown, even if arising from the negligence of the Organizers or others, and assume full responsibility for my participation.

3. Personal Responsibility & Conduct:
I am solely responsible for my own safety, well-being, and conduct while participating in any Event. I agree to follow all instructions, rules, and regulations provided by the Organizers, their staff, volunteers, and any associated instructors or performers. I will not participate if I feel unwell, am under the influence of substances that impair my judgment, or have any concerns about my health or safety. I agree to conduct myself respectfully and responsibly at all times.

4. Medical Conditions & Consent:
I declare that I am in good physical and mental health and am medically fit to participate in the Event’s activities. I have not been advised against participating by a medical professional. I agree that it is my sole responsibility to determine my physical fitness and ability to participate. If I have any pre-existing medical conditions, I confirm that I have consulted with my medical practitioner and obtained their explicit approval to participate. I consent to receive emergency medical treatment, if deemed necessary by Event personnel, and understand that any such assistance is rendered as a first aid measure and does not imply responsibility on the part of the Organizers.

5. Waiver of Liability and Indemnification:
In consideration for being permitted to participate in any Event, I hereby irrevocably waive, release, and discharge 365 BPM, its Organizers, directors, employees, volunteers, agents, affiliates, sponsors, partners, any associated medical personnel, instructors, performers, and venue owners/operators (collectively, “the Released Parties”) from any and all liability, claims, demands, actions, or causes of action whatsoever, arising out of any loss, damage, injury (including fatal injury), or property damage that I may sustain while participating in, traveling to or from, or in any way associated with the Event, whether caused by the negligence of the Released Parties or otherwise.

Furthermore, I agree to indemnify and hold harmless the Released Parties from any and all claims, demands, actions, suits, costs, expenses, damages, and liabilities, including reasonable attorney’s fees, arising out of or in connection with my participation in any Event, or from any action or inaction on my part, including my negligence or breach of these terms.

6. Personal Property:
I understand that the Organizers are not responsible for any loss of or damage to my personal property before, during, or after any Event, including any items left at the venue or along the course.

7. Image and Likeness Release:
I grant 365 BPM and its authorized parties the irrevocable right and permission to use photographs, video recordings, or any other media (including those of my voice, image, and likeness) taken during any Event for any legitimate purpose, including marketing, publicity, and promotional activities, without compensation or further notice to me.

8. Rules and Regulations:
I agree to abide by all rules, regulations, and instructions issued by the Organizers, their staff, and volunteers, including those related to safety, conduct, and the Event course/venue. I understand that failure to comply may result in my immediate removal from the Event without refund.

9. Severability:
If any provision of this Agreement is found to be invalid, illegal, or unenforceable by any court of competent jurisdiction, that provision shall be severed from the Agreement, and the remainder of the Agreement shall remain in full force and effect.

10. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa, and the Parties hereby consent to the exclusive jurisdiction of the courts of South Africa for any disputes arising hereunder.

11. Participants Under 18 Years of Age:
If the participant is under 18 years of age, a parent or legal guardian MUST read, understand, and agree to these terms on behalf of the minor participant. By proceeding with registration for a minor, the parent/guardian confirms they have the authority to do so and agrees to all terms herein on behalf of the minor, and fully assumes all risks and waivers of liability for the minor’s participation.
